These Terms of Use ("Terms") govern your access to and use of the Mantraminds website, platform, applications, services, consultations, assessments, educational resources, and other services provided by Mantraminds ("Services").

By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

Mantraminds provides mental health, wellbeing, educational, and related professional services, including access to psychiatrists, psychologists, therapists, counsellors, coaches, assessments, and other specialists, as applicable.

The Services are intended to support mental wellbeing, professional care, personal development, learning, and related needs.

Information and self-assessment or educational resources provided through the Services are not, by themselves, a substitute for professional assessment, diagnosis, treatment, or emergency medical care.

You must be at least 16 years old, or the minimum age required under applicable law, to use the Services. Certain services may have additional age or eligibility requirements.

If you are accessing the Services on behalf of another person, you confirm that you are authorised to do so.

By using the Services, you confirm that you have the legal capacity to enter into these Terms and agree to comply with applicable laws.

Payments and refunds are subject to the applicable Cancellation & Refund Policy and any specific terms communicated at the time of purchase.

Mantraminds may change pricing or introduce new paid Services without any prior notice.

Mantraminds may use automated or AI-enabled features to provide prompts, suggestions, summaries, educational information, or other insights.

Such features are intended for general informational, wellbeing, learning, or personal development purposes and should not be relied upon as medical, psychiatric, psychological, therapeutic, or other professional clinical advice.

AI-enabled or automated features do not replace professional assessment, diagnosis, treatment, or emergency assistance.

Mantraminds provides access to professional services including psychiatry, psychology, psychotherapy, counselling, assessments, coaching, and other wellbeing services through appropriately qualified professionals, as applicable.

Where a Service involves professional clinical care, the treating psychiatrist, psychologist, therapist, or other qualified professional is responsible for their professional assessment, clinical judgment, diagnosis, treatment recommendations, and other professional decisions within their scope of practice.

Mantraminds provides the infrastructure, administrative, scheduling, technology, and other operational support required to facilitate such Services. Mantraminds does not direct or influence a professional's independent clinical judgment.

Mantraminds may establish and enforce reasonable standards relating to professional eligibility, patient safety, documentation, privacy, technology use, prescribing safeguards, and lawful use of the Services.

No particular practitioner, treatment, prescription, or clinical outcome is guaranteed.

Where a consultation involves medication, any prescription is issued by the treating qualified professional based on their independent clinical assessment and applicable professional and legal requirements.

Mantraminds does not select, approve, or guarantee any particular medicine, dosage, treatment plan, or prescription.

Medicines may be prescribed through an online consultation only where permitted under applicable law and telemedicine requirements. Certain medicines cannot legally be prescribed through teleconsultation. Where an in-person consultation or other assessment is required, the treating professional may require the patient to follow that course before prescribing.

You must provide accurate and complete information relevant to your consultation, including your identity, age, medical history, current medicines, allergies, and other information reasonably required for safe clinical decision-making.

Patients are responsible for using medicines lawfully and in accordance with the instructions of the treating professional.

All content, design elements, software, text, graphics, interfaces, trademarks, and other materials within the Services ("Platform Content") are owned by or licensed to Mantraminds and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable right to use the Services and Platform Content for personal or authorised institutional use.

You may not copy, distribute, modify, reproduce, commercially exploit, or create derivative works from Platform Content without prior written permission, except where permitted by applicable law.

Your use of the Services is subject to our Privacy Policy, which explains how Mantraminds collects, uses, stores, and protects personal information.

The Privacy Policy forms part of these Terms.

Where you receive professional healthcare services, information may be collected, recorded, stored, or processed as required for providing care, maintaining appropriate records, administering the Services, protecting patient safety, complying with applicable law, and other purposes described in the Privacy Policy.

The technology, website, and non-clinical components of the Services are provided on an "as is" and "as available" basis.

Mantraminds does not guarantee uninterrupted availability, accuracy, reliability, suitability, or availability of any particular feature or Service.

Mantraminds does not guarantee any particular diagnosis, treatment, medicine, prescription, practitioner, appointment, or clinical outcome.

Clinical decisions are based on the individual assessment of the treating professional and may vary from person to person.

The Services are not a substitute for emergency medical care. If you are experiencing an immediate medical or psychiatric emergency, you should seek appropriate emergency assistance or attend the nearest emergency medical facility.

Nothing in these Terms excludes or limits any liability or obligation that cannot lawfully be excluded or limited under applicable law.

The Services may contain links to third-party websites, services, or resources that are not owned or controlled by Mantraminds.

Mantraminds is not responsible for the content, accuracy, availability, security, or practices of third-party websites or services. Your use of such services is subject to their applicable terms and policies.

To the fullest extent permitted by law, Mantraminds and its affiliates, officers, employees, representatives, and service providers shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or relating to your use of, or inability to use, the Services.

Subject to applicable law, Mantraminds' total aggregate liability arising out of or relating to the Services shall not exceed the amount actually paid by you to Mantraminds for the specific Service giving rise to the claim during the preceding twelve months.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.

You agree to indemnify and hold harmless Mantraminds, its affiliates, officers, employees, representatives, and service providers from claims, losses, liabilities, and reasonable expenses arising from your:

Mantraminds shall not be liable for delay or failure to perform Services resulting from circumstances beyond its reasonable control, including natural disasters, internet or telecommunications failures, government actions, public health events, cyber incidents, or other unforeseen events.

Mantraminds may suspend or terminate your access to the Services where you violate these Terms, misuse the Platform, create a safety or security concern, or where suspension or termination is required by law or reasonably necessary to protect patients, professionals, Mantraminds, or the integrity of the Services.

Termination of access does not affect provisions that by their nature are intended to survive termination, including confidentiality, intellectual property, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution.

Upon termination, your right to use the affected Services will cease.

These Terms are governed by the laws of India.

Subject to applicable law, disputes arising from these Terms shall be subject to the jurisdiction of the courts at New Delhi.

These Terms, together with the Privacy Policy, Cancellation & Refund Policy, and any additional agreements applicable to specific Services, constitute the agreement governing your use of the Services.

If there is a conflict between these Terms and a specific written agreement applicable to a particular Service, the specific agreement shall prevail for that Service to the extent of the conflict.
